There is no doubt that a lawsuit against an orthopedic surgical center was filed against both Orthopedic Surgeon and the staff there.
We all know that the Orthopedic Surgery Center is one of the best in the area. What is unclear at this point is whether or not there is anything to this claim. The patient has claimed that the services were not up to par and the hospital failed to keep her informed or advised her on what she should expect when she came through the surgery. Although this may be true, there is no question that orthopedic surgeons are dedicated individuals that do their best to improve the overall quality of patient care.
The Talisman Casualty Lawsuit states that the surgical center did not adequately inform their patient about the chances of complications with the procedure. They also failed to inform her of the actual risks.
As far as health care goes, being informed is always a good thing. If the patient is given accurate information, they are more likely to adhere to their instructions and, consequently, the outcome will be far more favorable. We all wish that the whole could get along with patients and offer them reasonable, if not a little more reasonable, information and instructions.
A good practice, though, is to have patients sign an attestation form to this effect. It should read something like, “I hereby state that I understand the risks of undergoing this procedure and do so in the best interest of my body and health.” This is of course a great idea, but more importantly, it is common sense.
As far as any harm is concerned, we can only speculate at this point. Itcould be that the client decided to seek his own treatment, perhaps because he had recently been in a car accident or suffered some sort of trauma, which caused him to be discharged from the hospital in a very low-grade condition. Then, it could be that he decided to go back to see his doctor.
It is also possible that the clients may have made up their minds to pursue legal action against the Talisman Hospital and its staff, but the sudden departure of the surgeon may have made the final decision easier to make.It’s Talisman Casualty Insurance Company too soon to say how this all will play out.
